Hunter Water Regulation remake

The Regulation under which Hunter Water supplies water, sewerage and drainage and wastewater disposal services has been renewed.

Background

The Hunter Water Regulation 2015 is a statutory instrument under the Hunter Water Act 1991 and is used to regulate activities in the catchment areas and water storages, compliance with plumbing and drainage standards, protection of Hunter Water works or property or assets, and implementation of water restrictions. The regulation supports effective, efficient and prudent operations of Hunter Water in delivering its services to the community.

The Regulation was due for staged repeal on 1 September 2024, in line with the Subordinate Legislation Act 1989 (SL Act). The SL Act states there is an automatic repeal of regulations after they have been in force for 5 years.

Under the staged repeal program, each regulation due for repeal must be reviewed and a decision made to:

  • allow the regulation to be repealed
  • remake the regulation (with or without amendments)
  • seek a postponement of the repeal of the regulation until the following year.

The Hunter Water Regulation 2015 had previously been extended and in 2024, the department proposed to remake the Regulation with minor changes.

Report

The department undertook a 3-week public exhibition to seek feedback on the proposed changes. A What we heard report has been prepared, summarising the feedback received during the consultation period.
